Montgomery County officials announced today that the Republican National Committee (RNC) has withdrawn a lawsuit filed against the county last month.
According to the press release, the lawsuit was related to alleged issues with mail-in ballot testing.
On Friday, October 11, the RNC withdrew the preliminary injunction after Montgomery County provided a factual statement outlining Voter Services processes. The RNC withdrew its full case three days later.
In his memorandum opinion, Judge Richard P. Haaz said, “Petitioners have failed to produce any evidence that Montgomery County has violated any federal or state law. Petitioners have failed to produce any evidence of any inaccuracies or errors in Montgomery County’s use of the Dominion Democracy Suite 5.5A voting system. Petitioners have failed to produce any evidence that the testing procedures employed by Montgomery County are unlawful or inaccurate. The evidence produced in the hearing supports the opposite conclusion—that the Dominion Democracy Suite 5.5A Electronic Voting System has been extremely accurate in properly recording all votes in Montgomery County elections since its implementation.”
The county noted that 81,929 ballots have been returned so far, and that a new lawsuit has been filed which targets the new Voter Van.
