Republican National Committee files lawsuit against Montgomery County for starting election process without testing ballot equipment

The Republican National Committee (RNC) filed a lawsuit on Friday, September 20 against Montgomery County, which would temporarily stop county officials from distributing and collecting mail ballots, the Philadelphia Inquirer reported.

The RNC is accusing the county of starting their election process without fully testing voting equipment. The suit demands that the county hand count all mail ballots that have already been distributed.

The Department of State has called the lawsuit frivolous and said Montgomery County did everything required before sending its ballots.

According to the lawsuit, the RNC claims that, as of September 13, Montgomery County officials hadn’t certified their logic and accuracy testing of the county’s voting machines. On September 16, Pennsylvania Secretary of State Al Schmidt finalized the names that will appear on the November general election ballot, officially certifying the ballot and effectively kicking the election process into motion.

On September 17, Montgomery County election officials began mailing out ballots. The RNC claims that Montgomery County’s logic and accuracy testing wasn’t completed by that time, violating state law.
