Montgomery County District Attorney Kevin R. Steele and Rockledge Borough Police Chief Michael Schmalz announced today the arrest of Jose Luna, 59, of Philadelphia, who is charged with First-Degree Murder following the fatal shooting of his wife, 48-year-old Alisett Schubert, on Saturday, February 21.
According to the announcement, Rockledge police responded at 10:05pm to Huntington Pike and Filmore streets after a SEPTA bus driver used his emergency system to report a shooting and a description of the shooter.
Police found Schubert on the ground suffering from multiple gunshot wounds outside of her vehicle. She was pronounced dead at Abington Hospital, officials said.
According to a SEPTA driver who was driving southbound on Huntington Pike, two or three “pops” were heard before a male, later identified as Luna, exited the front passenger seat of the vehicle, opened the driver’s side door, and walked away. Schubert reportedly fell out of the vehicle.
The driver pulled over and called in the emergency and a description of Luna. Philadelphia police found him one mile away from the scene. As officers approached, Luna reportedly put a gun to his head and pulled the trigger, but the firearm was out of ammunition. He was then arrested without incident, officials said.
The joint investigation by the Montgomery County Detective Bureau and Rockledge police found that the firearm was registered to the victim.
Luna is charged with First-Degree Murder, Third-Degree Murder and Possessing an Instrument of Crime. No bail is available for charges of First-Degree Murder, officials said.
A preliminary hearing is scheduled for 10:00am on March 5.
