Congresswoman Dean calls for the recusal of Supreme Court Justice Samuel Alito Jr.

Congresswoman Madeleine Dean, whose office is in Glenside, announced that she is calling for Supreme Court Justice Samuel Alito Jr. to recuse himself from all cases with ties to the January 6, 2021 Capitol attack and the 2020 election.

“Chief Justice Roberts’ Supreme Court continues to be far too political which is why I previously called for a SCOTUS code of ethics,” Dean said in a post. “An upside-down US flag flown outside of Alito’s home is egregiously political and unbecoming of a Justice.”

Dean is referring to an upside-down American flag flown outside of Justice Alito’s Virginia home two years ago. The flag’s inversion became a symbol of the “Stop the Steal” movement after the election.

She shared the following letter in her post, which specifies a request for Justice Alito to recuse himself from the Trump v. United States and Fischer v. United States cases:


According to the U.S. flag code, which is not legally enforceable, the flag is not to be inverted “except as a signal of dire distress in instance of extreme danger to life or property.”

The New York Times reported today that Justice Alito’s beach house also displayed an “Appeal to Heaven” flag outside his home on Long Beach Island in July and September of 2023. The flag, also known as the Pine Tree flag, is a symbol with roots in the Revolutionary War and carried on January 6. It’s also associated with a push for a more Christian-minded government, the Times said.


The flags are headlining as of late because a key January 6 case challenging whether those who stormed the Capitol could be prosecuted for obstruction is to be ruled on over the coming weeks.

Multiple legal ethics experts considered this a clear violation of ethics rules as the flag could be seen as telegraphing Justice Alito’s views.
