Erick James Rutherford, 35, of Philadelphia, was arrested on Monday, August 31, for assaulting police officers, damaging police property, and resisting arrest, among other charges.

According to the criminal complaint, Cheltenham police responded to the Wawa at 8250 Limekiln Pike in Wyncote at roughly 7:00pm in reference to a disturbance involving a male “being aggressive with staff.”

Arriving officers learned that Rutherford was still in his vehicle. When confronted, he reportedly refused to present a form of identification and raised the music volume “to the max level” before stating to the officer ‘”I don’t wanna hurt you alright'”. Officers then removed Rutherford from the vehicle and placed him on the ground. He resisted arrest “and eventually got back on his feet and continued to pull away from police”.

Additional officers arrived on scene to assist with the arrest, during which time Rutherford continued resisting arrest and “would growl and attempt to bite me”, the reporting officer wrote in the complaint. “The defendant’s teeth did make contact with my skin causing minor injury”.

After being taken into custody, Rutherford “used his left and right hands to strike the camera over 25 times”, the complaint said.

Rutherford’s charges include aggravated assault, disorderly conduct, resisting arrest, institutional vandalism, failure to exhibit a driver’s license.

All persons are considered innocent until proven guilty in a court of law.
