John L. Ingram III, a former bus driver for the Abington School District Authority, filed a lawsuit on January 15 against his former employer.
Ingram, a cancer survivor, is alleging race and disability discrimination after being unable to take the COVID-19 vaccine.
Ingram claims that he experienced “disparate treatment and a hostile work environment” during his tenure with Abington schools, according to Pennsylvania Record. He also claims that Jennifer Williams, Assistant Director of Human Resources at Abington School District Authority, mistreated African American employees “by applying greater scrutiny to their work and offering fewer accommodations than those offered to similarly situated Caucasian bus drivers,” the Record said.
The complaint includes Ingram’s allegation that he was instructed to return to work in September 2020 after expressing concerns about his health and the health of his family members, some of whom also have compromised immune systems.
According to the Record’s article, he requested “reasonable accommodations such as unpaid leave and an accommodated vehicle” but instead received “an ultimatum to return to work or face consequences in February 2021.”
The Civil Rights suit, titled “INGRAM, III v. ABINGTON SCHOOL DISTRICT AUTHORITY”, invokes The Americans with Disabilities Act of 1990. A summons was issued to the Abington School District Authority on Tuesday, January 16.
The case will be heard by Judge John M Younge.
